Following the TPD the Swedish equivalent of the MRHA (MPD) supports the opportunity it gives to follow with Med regs. Something certain previously supportive MEPs said was unlikely to happen.
This is doing the Twitter rounds. I have with some difficulty managed to translate into English but only in bits. If anyone knows how to translate the page please post. Essentially though they see ecigs in the same way as NRT
If they do and others follow suite we can hopefully expect legal challenges

"New tobacco directive clarifies the regulation of e-cigarettes
February 27, 2014
MPA welcomes the new Tobacco Products Directive which was passed in the European Parliament on the 26th February. The directive covers e-cigarettes, but makes clear that e-cigarettes should be regulated as drugs if Member States are satisfied.
The new tobacco directive covers e-cigarettes with nicotine, and sets clear guidelines and requirements for the product. It is also clear that Member States shall apply the drug laws in which the e-cigarettes are classified as drugs, ie. the products through their presentation or function which fall under the Medicines Directive. This means that the products are expected to affect physiological functions or they are marketed for medical purposes.
Before the directive is given its final formulation Ministers should also formally approve the text. Member States then have two years to carry out and implement the Directive into national law.
For e-cigarettes with nicotine that are available to the market today, the MPA has made the assessment that because of their function they are classified as drugs. The demands placed on NRT is therefore valid for e-cigarettes. So they are not allowed to be sold unless they are first approved by the FDA.
- Anyone who wants to quit smoking with e-cigarettes should be confident that the product is effective and safe to use, says Martin Burman investigators at the MPA."
