Fasttech are selling fake Hangsen eliquids

I'm reading these posts and chuckling to myself, there is a reason that I and many others don't buy from China, this is because they have no copyright laws and no right of recourse. Look at the BMW fiasco if they can replicate a BMW they can get away with anything. In the U.K or Europe if we label something incorrectly we can be pulled before the courts or have trading standards on our back. The same applies if we use materials or ingredients that are harmful. In China it is almost impossible to to sue a Chinese company, they can put what they like in the bottles and call it what they like.

If they copy the likes of Apple and even smoke alarms why would they not copy a popular brand of E Liquid? You can never be totally sure of what they put into your liquid or the conditions that they have been made in. Don't get me wrong there are some good companies in China that care about the product but some are just after your money. If the product harms someone or they get bad press they just shut the business down and reopen as a new business. All this costs them is the cost of changing name.

I personally am not happy risking it when the end product goes into my body, my insurance company also refuses to cover me for Chinese E Liquids (not that I want them) as if something goes wrong they know that they have no right of recourse in China (from past experience) and they would be left picking up any damage claims.

I'm not totally against Chinese (have been there and loved it) but it's a risk that I'm not willing to take. :)
 
China DOES have Copyright IP and trademark laws.....and they are a part of the Universal Copyright Convention... I have posted up about this previously.


BUT there are a lot of violations and by the time it gets through the court system, he offending company has made its money and then some to pay off any legal fees and settle.


We all forget China is ran very different than most places in the world, but they are not free from basic laws and are not a country full of ignoramus.

its something everyone is getting into even I considered it myself because quite a few companies will package it for you. my local shop brought out a liquid that was made in china they put a union jack on the package and even stated made in the uk however after I pulled them on it they re-packaged left the union jack on though which I still feel is wrong.
I have lost count of the amount of sellers who tell me blatant lies.

That's terrible, you should have reported them to trading standards. At least within the EU we have laws that are meant to protect consumers, but this just shows why it's important to always use a supplier that a) you can trust and b) a legally compliant and fully insured for the products they carry. Anybody can mix their own with a little knowledge but you need to understand your supply chain if you are buying the ingredients to ensure you get what you are asking for.

I totally agree that they do have laws, however it is harder for someone outside to prosecute a company in China or reclaim damages, when something does go wrong in China they are more lenient than elsewhere in the world. The biggest question is if it gets to court and then what the court decides. If you look at the case of BMW vs Shuanghuan then BMW lost the case despite the rest of the world stating that the car was almost an exact replica of the X5 except for the badge.

They do have laws and also some very good companies, however as an emerging economy we know that sometimes things do go wrong. If / When people decide to buy from China (or anywhere else for that matter) they should research into what they are buying so they know what they are expecting when it arrives, they can then try to determine if it is the real Mccoy (harder to do nowadays as copies can be exacting) As long as you know it's a company that you trust then you should have no issues, (except for items missing in the post, but Royal Mail also loose post).
 
if a UK company IE POTV does not Trademark our Brand/Logo in China, they are free to use it as they see fit in their own country but had we trademarked it in China as well as the UK, legally they could not use it and would be held accountable under China law if it was pursued. Most companies dont pursue it.
