I think sigelei made their kick a tiny bit bigger on purpose, because most sigelei mods are 23mm so they made the kick to suit, only a fraction off each corner is all that's required

firstly how would i test it without shocking myself secondly am sure the member I bought it from would have tested it also

You would have thought so but one of the basic rules of survival is 'never assume'. You could codge up something but I can only advise you to use a multimeter. Put a battery in the tube, an atty onto the mod and then set your multimeter to 20v and then check if there's a current between the mod and the atty body. With the new 'safe' head supplied by iVapour mine is live which means if yours is similar and you or the littl'un say, was to touch a spoon between the two, the eyes would rotate at an uncomfortable speed!
