So, ive had the website taken down for around an hour but finally got it back up and running.
After chatting with the customer services (Justhost) they have said i have to remove all products that contain nicotine as its tobacco related.

hmm...

Any ideas on how to get around this would be great.
 
can see nothing in there terms and conditions about restrictions on nictone based products. id ask to see where it states you cannot sell them and where it is against there terms, if they cant show them tell them if they close you down they are in breach of contract and you will take them to court.
its a total farce and a disgrace to discriminate if its not in there terms and conditions.
add to that ecigs have as much bearing on tobacco as NRT products do such as patches or gum. there is ZERO tobacco and as such doesnt fall foul of whatever terms and conditions they try to concoct.
in the meantime also look for another host and export your site now before they take it down so you have it fully saved in case you need to make a quick switch.
also might be worth talking to other UK vendors to see who there hosts are as this could be the next thing that happens down the line with host sites banning any sale of ecigs... another bloody nail in the coffin if that happens

so as long as you have age verification they can do fuck all and cant ask you to take it down.
page is here. i suggest you screen capture it with date as proof in case they try and change it and then email them with the information stating that your site falls within there terms and they have no rights to close you down

this is the only reference to tobacco across all there terms and conditions
 
as currently there is no ban in the UK and you are UK based they may argue about section ii but as far as im aware nowhere has yet banned the sale and if any overseas countries have then just put a disclaimer stating sale to UK and europe only or some such thing . dont let the bastards get away with this kinda BS

First, ecigs arent a tobacco product. We actually use synthetic nicotine, which isnt even from Tobacco plants. It is also NOT illegal to sell them in the UK and if you use PayPal, paypal all ready has an age restriction of 18 yrs on it.

Synthetic nicotine? So all the nicotine in the liquids is not extracted from tobacco?

It's not "technically" synthetic, but if you think about it... Nicotine can be extracted from a variety of plants, once it goes through the pharma grading process and impurities removed, it's in it's purest form, which can't be obtained without all the processing... therefore it basically changes it from its natural state to another purer state and contains nicotine from a variety of sources.


The definition of nicotine also states
Nicotine: An alkaloid (a nitrogen-containing chemical) made by the tobacco plant or produced synthetically


Even research has confirmed Nicotine comes from tobacco derived plants OR synthetic sources.
