My tuppence, for what it's worth...
In the world of manufacturing, many a profit has been made 'refining' someone else's creation. All above board and legal like.
If you gained access to the exact recipe for Red Astaire, then changed one ingredient for a very similar one then you have a unique product.
However, morally speaking, if you were to do that and make a profit from it, then that makes you a fucking leach.
For me, to directly copy and alter is wrong, but if you attempt to recreate from scratch (even using bought concentrates, assuming it's not theirs) then why not? It's all about approach.
Someone shouldn't have the monopoly on a taste. After all, many liquids are assimilations of popular drinks and sweets, and I don't hear many vapers complaining about that.
