You could also ask the retailer to repair or replace your item within six months of purchase."

Hopefully you notified them within 30 days.

Contact trading standards in their area..... They might already be known to them
 
lol, bad example then maybe ...... but you get my drift, I think we feel easier standing our ground in big shops (well I do anyway) because generally the staff aren't paid much and they can't be bothered to argue with you, when it's the shop owner of a small shop I always feel it's a little more difficult..... maybe?

When I was at uni I worked in Woolworths on the 'entertainment' counter as we didn't even ask any questions, you just refunded because at the end of the day you didn't want the hassle and you didn't want to have to go and get the manager. :) ...... but they did go bust I guess. :D

As others have said, they have a legal right to supply you with a product fit for purpose for a reasonable amount of time.

You're well within your right for a full refund/exchange.
 
I missed 2 pages of replies here as i stopped getting notifications for some reason.

I tried contacting them again, no response, sent another email...no response.

Went to the website URL...shop no longer exists.

I dont think there is much I can do about it now sadly, if they are no longer trading, guess i will have to chalk it up to experience and in future:-

1. Only use very well known websites, even if they are slightly more expensive.
2. Never buy a Tesla product again (as they also have never replied to my contact request about the issue either).

Can you not try to get some kind of compensation via PayPal or your credit card company..or however you paid for the goods?

I have started a dispute with PayPal now, first port of call seems to be contacting the seller via paypal, i dont hold out much hope of a response there due to him not replying to direct emails.

Paypal are usually pretty good in making sure the customer is happy in the case of a dispute in my experience, but have never had a dispute with a vendor who has since ceased to exist so dunno what will happen. Have my fingers x'd that Paypal will come thru for you tho' :)
 
Paypal are really good these days. The onus is on the seller I'm sure if you contact them and explain they will refund your money.
 
Hopefully so, I lodged the complaint with PayPal and Aaron Chapman (the owner of DateVape) actually replied, his response was pretty much as expected, here is what he said:-

In response to the case in question, the buyer did receive the item as stated when he bought it. The item was brand new and sealed and also with authenticity verification. The buyer did go on to the manufacturers website (of the questioned item) and in deed verify that the item was a genuine piece of hardware. The reason for this 'case' being opened is because the buyer is claiming that the item was not as described when in fact it was exactly as described, he received it by courier and accepted the item. Like I said earlier the item is genuine and authenticity was validated so as far as I'm concerned there is no reason for further dispute of this matter. If there are Mechanical faults that he is trying to claim for then all the relevant returns policies were stated on our website and visible for all to see. I can not and will not be held responsible for someone's negligence to follow the proper procedures. I welcome your response to this matter. Thank you in advance.Aaron Chapman
Note, I didn't raise the issue as 'not as described', it was raised as 'faulty', but that is a sub-category of 'not as described', but still, the guy is missing the point.

I have updated PayPal to emphasize that it was faulty goods and explained my position in terms of not reading the returns policy (who does that when buying something as you are generally not expecting to return something) and to explain again that my contract was with the seller, not the manufacturer, which I have tried to explain to Aaron, with no success.

I await further updates.
 
Update Paypal by telling them that he's since closed the shop. Gives your argument more weight.
