French tobacconist sues e-cigarette vendor for unfair competition

A French tobacconist has sued a shop selling e-cigarettes for unfair competition. As the European Union prepares to tighten anti-smoking laws, lawyers on both sides say there is a "legal vacuum" concerning electronic cigarettes.


The plaintiff, who runs a tobacconists in Toulouse, south-west France, is suing a nearby shop, called Esmokeclean, which opened in June.


He accuses its owners of breaching the legal monopoly on the sale of tobacco products in accredited outlets by promoting their wares in their shop, on Facebook and on their internet site.


E-cigarettes "recall the act of smoking", he argues, and cites Health Minister Marisol Touraine's declaration during the debate on restrictions of e-cigarettes's use that they should be subject to the same laws as tobacco.

Vaping isn't tobacco (unless you add in the nic from a different process)
It isn't smoking, it is living, and i think the tobacconist missed a trick by not getting into e-cigs!

It isn't a monopoly. They sell different products so meh... stupid legally trained cheese eating surrender monkeys for even allowing it to get through litigation..

Always found it daft that I couldn't buy fags in French supermarkets when I was over there, and had to seek out a little tabac to buy them a pack at a time, instead of 200 cartons.

Although being able to buy horse burgers made up for it.

Looks like the crunch is coming sooner than you think.
That says to me, that tobacconist number 1 is running outta customers, and he's not a happy bunny.
And the more than turn to e-cigs the worse it's gonna get, for the tobacconist's.
Perhaps they need to BOGOF, or have a 20% off sale to try and get customers back.

This is pissing me off they always say smoking is bad for you but they dont want us to vape what the f do they want us to do.
