An importer that supplied unsafe chargers for electronic cigarettes at Dorchester Market has been prosecuted by Dorset County Council’s trading standards service.


On 31 January 2014, at Bournemouth Magistrates’ Court, Vapertrails Limited of Alma Road, Bournemouth, pleaded guilty to three offences under the Consumer Protection Act 1987 of supplying three different types of unsafe battery charger for use with electronic cigarettes.


The products failed the Electrical Equipment (Safety) Regulations 1994 with varying degrees of risk to the user. One posed a direct risk of electric shock to the user, another had the wrong colours of wiring to comply with the British Standard and the third had a two pin plug which could not be safely connected to the mains. None of the items carried the correct markings and none came with instructions. Vapertrails Limited were fined £2000 for each of the three items and ordered to pay prosecution costs of £1500 and a victim surcharge of £150.


The court heard that in October 2012 officers from Dorset County Council’s trading standards service visited Dorchester Market to check that any electrical items on sale were safe. They found the chargers being sold from a trailer and seized the items when they failed a screen test conducted at the market. Subsequent examination by an expert witness proved that the chargers did not comply with the safety regulations.

In mitigation the company stated that these items had been sent from China as samples and had not been intended for supply to the public. However, at that time the director of the company had a number of personal problems which meant that he did not have full control of the company and the chargers had been allowed to be sent out. Matters had now improved and the company had taken advice from their local trading standards service and they were now confident of only selling safe products.


Ivan Hancock, trading standards service manager for Dorset County Council, said:

“We have become increasingly concerned about imports of cheap charging devices, many of which are being imported directly from the Far East by quite small

businesses or just individuals trading via the Internet. Anyone importing electrical products has to address their responsibility for ensuring products are safe otherwise they will put UK consumers at risk."

Appropriate regulation, properly enforced.

If trading standards had the manpower to carry out more spot checks, then a lot of the negativity surrounding vaping could be easier to dispel.
 
Trading Standards need to start visiting pubs to catch "blokes selling shit for £25 to housewives" then perhaps the Daily Fail won't keep saying these devices explode.

TS have the regulations/power to reduce the dangers posed by chinese crap,I'd like to see more of these types of story.
 
This will happen more and more yet it cost nothing to do research and ensure that what you want to sell is safe. We will see many more cases like this and there is no excuse that can be offered. As vendors our priority is and must be to ensure that what we sell is safe. This is quite an established company and i am frustrated that he can let this happen. i hope that he does a recall on all of the adapters that are out there as a result of this.

Please please please any vendors new or old that stock the generic chargers supplied by China use this as a example and take action now and BIN them.

Oh dear me... And that`s exactly why we don`t sell chargers, batteries or liquids... Even 1 faulty batch can cause a lot of problems..
Always buy only from trusted vendors and avoid market stalls at all costs

Completely agree,I had a look at one of VT's shops a while back and wasn't impressed,was even less impressed when I was talking to the guy about to buy a tank and his phone went off and he walked away and took the call,if I want stuff when I'm down that way in future I think I'll head over to Blandford.

reading between the lines is it possible that one person has had an accident with the chargers in question, come forward and complained to the TSA and got a poultry £150 while the company paid £7500 to ......government? or other?

You have fella, the victim surcharge means that £150 has gone into a pot, and when compensation is claimed by a victim after a crime, the money is paid out to them out of this pot.

I totally agree with everything that has been written, BUT, I also have an issue with companies selling stuff that they have no idea what they are selling. I went into a B&M a few months ago when it first opened, and a lot of things I heard/saw/was told by the management was horrific to say the least. I did try a bit of education without trying to come across as arrogant, and put it down to their newness within the industry.

I went back in just after Xmas..........and it was the same :( I hear stories all the time from people who have bee 'mis-sold' stuff, and I always seem to be putting right the mistakes of the B&M store concerned. :(

The next time, I will be reporting them to the relevant associations being ECITA and ECCA.
