What does not seem to be clearly understood here is that the legal offence has nothing to do with the TPD/TRPR at all, it's not specific to vaping.
Legally it's all covered in the UK Food Imitations Safety Regulations 1989 and the EU Regulation 1272/2008 on Classification, Labelling and Packaging of Substances and Mixtures.

It's a potentially hazardous product being marketed and sold as an imitation food/drink product ... it can be misleading to a consumer or child due to its "form, odour, colour, appearance, packaging, labelling, volume".

It's not simply that we might consider it a disgrace, or bad news for vaping, or fuel for the antz ... it's not a matter of personal opinion whether parents are responsible for what their child can get their hands on - it's against the law to produce and sell such things!

It does happen in other places too. The difference here though, is if a kid got hold of this, it might get some of its mothers growler juice on it.

Elsewhere. With the powers that be now closing further loop holes, isn't it time the whole industry really started working together responsibly, more than ever? Parental responsibility is one thing (I'm very old school), but a lot of the parents I see shouldn't be allowed to reproduce anyway, hence why the nanny state exists.
 
Legislation covering food-imitating products
A number of laws prevent the sale of potentially dangerous food-imitating products, and these are listed below:

Food Imitations (Safety) Regulations 1989
  • presentation (and in particular its form, odour, colour, appearance, packaging)
  • labelling
  • volume
  • size
These Regulations prohibit the marketing, import and manufacture of products that look like foodstuffs but that are not in fact edible. In particular they prohibit the supply of goods that have one or more of the following:

  • form
  • odour
  • colour
  • appearance
  • packaging
  • labelling
  • volume
that children could confuse with food and put in their mouth or suck or swallow, which may cause death or injury. Injury can include choking, strangulation, cutting, poisoning, or even causing a child to vomit.

EU Regulation (EC) No. 1272/2008 On Classification, Labelling and Packaging of Substances and Mixtures
Under this Regulation, dangerous preparations such as detergents, drain and oven cleaners, glues, polishes, etc must not be supplied in a shape that:

  • attracts the active curiosity of children
  • misleads consumers
  • looks like packaging for: food (for animals or humans), medicines and cosmetics
 
Can anyone anywhere provide a link showing where this product is being marketed, advertisd and sold in those bottles looking exactly like that ONE photograph everyone's getting righteous and angry about?
I'm guessing it's unlikely because I don't think it is available for sale, it's a personally made item or prop for the photo, the ONE photo that's evident on here or a google image search!

ranting is always pointless......... BUT in the bigger more sensible discussion about how vaping products and e-liquids are promoted/advertised/branded I don't think it is pointless.

This picture was posted on this forum by a vendor, so it's advertising ..... does it look like a bottle of drink? yes it does. ... I don't know why you don't think that should be talked about.... or people's concerns are invalid.

People like to compare e-liquid to bleach a lot of the forum so how would you feel if that was a bottle of bleach? regardless of whether it was actually sold in those bottles...

... or a bottle of bleach that looked exactly like an e-liquid bottle/brand?

There's one of the problems ... there is no single body which acts on behalf of the whole vaping industry that I'm aware of. Vaping is a consumer-led phenomenon, there is no body which acts to lead on self-regulation. Where self-regulation does not exist or does not work, governments regulate instead.

We've tapped into an idea on this though ... as a consumer-led industry, let the consumers lead in boycotting the juice makers who act irresponsibly ... and illegally?

True. From what I've gleaned in my short time vaping, there were/are lots of little factions fighting against unjust legislation, but unwilling to work with each other. There were some small successes, but had they pooled their resources things could have been so different. But what do I know hey?

The best thing to do would be for all vapers to boycott all juice makers. Serve them right for being such a bunch of irresponsible, lazy, self-serving, profiteering, unregulated criminals.

Save vaping - switch to DIY! :)
