Yes they shouldn't of sacked him, as immediate dismissal these days have to comply with a companies policy on gross misconduct, as this is not covered in a policy there can be no gross misconduct.
Given this fact I am going to read between the lines and assume he has received other disciplinaries maybe even been requested not to use the device.
On his fault, he should of simply checked 1st to see if it was ok, assumption here again is either one of the ignorant tossers that says I can legally so fu or new he was in the wrong.
