Being forced to vape in the smoking hut!

I'm finding that the managment at work are more ignorant than I thought!

Not being able to vap on the production line or canteen I understand, wasn't allowed to smoke there.

But it seems that the only place I am allowed to vape is in the smoking hut. Being forced to back to second hand smoking. Is there anything I can do or legal recourse I can take?

Do what most of us seem to do- vape in the bog! It might not be the most pleasant place, but at least it's relatively warm and dry!

I am told I have to leave the hospital and walk 'off site' to Vape, the same as the smokers do... which quite apart from being a PITA, isn't particularly safe as a lone female working nights in a pretty rough area... bugger them, the stationary cupboard, laundry room and Sluice are OFTEN in need of attention when I'm working, and I DO have a weak bladder, honest

I suspect that employers who are forcing vapers to stand with smokers could be laying themselves open to legal action.

You are not smoking - would they force coffee drinkers t stand in a smoky environment?

Try the union or ACAS for advice on whether a non-smoker might have legal recourse for being forced into smoking areas to pursue a reasonable recreational activity (taking into account that they provide facilities for smokers, it wouldn't seem fair or reasonable for them to say you must choose between smoking zone or abstinence).

Also, don't be too quick to accept that just because smoking isn't allowed inside that it's reasonable not to allow vaping inside. Smoking's banned inside because of the law - there is no law, or any logical reason, why they shouldn't provide an indoor space for vapers, even if that is separate to working/eating areas.

You have a right to NOT be subjected to second hand smoke in the workplace. They cannot make you go and vape with the smokers. If they won't let you vape on their premises then tge least they can do is let you vape at the gate.

I asked the union rep/safety officer today, he went off and asked. He didn't even get to finish the question before he was told "no".

Insist that you not be forced to vape with other smokers as you are NOT a smoker. Indicate that as a non smoker, you do not want to be exposed to the cancer causing (this has been proven by scientists and recognised by the MHRA, NHS, and the WHO as well as other medical organisations) second hand smoke and that you ask that the management come up with a suitable alternative, other wise you will vape at an alternative location ON the property so that it does not interfere with your work performance or infringe on your right to choose a safer alternative while not being forced to suffer through the smoking shelter.

Oh yeah, it might be of benefit to get a letter from your doctor indicating that you are NOT a smoker

This can be done by answering one of those stupid "Do you Smoke?" Questionnaires, then asking the doc to put it on official letterhead

Nope, I'm a Psychiatric nurse, work at the big Psych hospital in Brislington.. not the sort of place you want to be hanging around at 3 in the morning on your own!
