And from European conservative and reformist group
EU set to introduce draconian overregulation of e-cigarettes
Brussels, 16th December 2013

A provisional deal reached tonight between MEPs and national governments on a new Tobacco Products Directive (TPD) will take the majority of e-cigarettes off the market.

European Conservatives and Reformists Group leader and shadow rapporteur on the directive Martin Callanan MEP said he could not support the agreement, which would enable the EU to ban ‘refillables’ (which comprise a large component of the e-cigs market), if only three EU countries ban them. It would also restrict all but the weaker e-cigarettes (20 mg/ml nicotine), and it would introduce burdensome new manufacturing provisions for nicotine cartridges that go beyond the safety measures needed to make then child proof.

The TPD was originally aimed at discouraging younger people from taking up smoking. However, Mr Callanan now believes it could have the perverse effect of pushing people who have moved from real cigarettes to electronic cigarettes back to the more harmful option.

Mr Callanan said:

“This is a perverse decision that risks sending more people back to real, more harmful, cigarettes.

“Refillable e-cigarettes would almost certainly be banned, and only the weakest products will be generally available. As many smokers begin on stronger e-cigs and gradually reduce their dosage, making stronger e-cigs harder to come across will encourage smokers to stay on tobacco.

“E-cigarettes have helped people give up tobacco. They are not completely safe and they may need regulation but they are a great deal safer than cigarettes and this agreement will make them harder for smokers to obtain.

“The fight is not over. National governments and the parliament plenary must still endorse this deal. We will continue to fight for sensible and proportionate regulation of e-cigarettes.

“The EU keeps talking the talk on producing more sensible legislation. This legislation shows it clearly isn’t walking the walk. Thousands of e-cigs users have contacted me, and I will keep fighting for them until the last minute.”

As I understand it, this still has to be taken back to the Parliament Plenary and the Full Council. The Parliament has not completed it's first reading, if enough pressure is brought on mep's they can still vote this down, and even the council may change it's mind under pressure and vote against the trilogue negotiated document... We need to keep fighting, we need accurate information too...

But the decision to ban refillable cartridges and devices has been taken without any evidence of health and safety dangers to consumers.

They've more chance of banning clouds than refillable devices.A quick wander round fleabay reveals that there are a vast array of refillable atomizers(for ladies to fill with their smelly stuff)that hold oil/solid/gels etc & quite a few that state they'll hold liquid,& I'm pretty sure anyone with a little bit of ingenuity could create some kind of adaptation that would allow us to build a vaping device.Or manufacturers would simply import atomizers "for bath oils" that also accept a 510 driptip. Therefore,I'm content to say to the EU arseholes "fuck you & your braindead regulation"

just read article here too

its pathetic the excuses they are making to try and ban them.. saying they could encorage heroin users take up vaping by sticking the liquid in them.. FFS are they for real... in that case ban lighters, spoons and syringes too.. heck why not ban heroin... oh what you mean it is.... so how come they are admitting people use it then? the saying clutching at straws springs to mind.

the article states

Under Monday night's draft compromise, refillable cartridges would remain legal for now, according to two officials. But if problems appear in at least three member states, the European Commission, the EU's executive, could move to ban them, they added.
However, the officials stressed that it was too early to say whether the plan would find sufficient support. "It was quite new," one official said of the draft compromise. "We need to discuss it with member states."

what problem exactly would that be?? herion users instead of shooting up with a needle vaping the damn stuff.. well sorry but thats heroin users problem not a vapers problem.

just sounds to me like a desperate act with ZERO solid proof of any cause or reason to ban them so they just try and come up with any old crap.. next it'll be cited as mechs will be banned cos they could be used as a weapon!

+1 Tubs on the accurate info. I'm struggling to find it at present. I'm sure there will be more detail coming through tomorrow. But you are most certainly right, battle lost , full out war begins...

As for availabilty of equipment, well not everywhere is in Europe, it's pretty easy to get stuff shipped in from USA, China, etc. I'm damn sure the Russians will be delighted to supply stuff and nowhere have I seen any mention of actually banning liquid nicotine, flavouring concentrates, etc; But we need to see the final text before we know the whole truth...

As it states, the decision today in Trialogue is only a single step again but on this occasion it is not down to an MEP vote but merely a discussion of ideas from three parties. This now goes back to the Council so we have some way to go yet AFAIK
