You're going to need to give them an opportunity to fulfil the order before you can do anything. When a reasonable time has elapsed, and they have failed to respond to your emails and phone calls as they do. I would advise contacting your bank to advise them you've been ripped off, and also Trading Standards, like I did.
So i got impatient and decided to go ahead and contact my bank, just to entertain the idea of a refund - even in the extremely unlikely event the mod arrives, i don't want this company to have a penny of my hard earned cash
So for anyone who didn't use Paypal (that banks with HSBC) it seems you can raise a claim after just 2 weeks of not receiving the item.
They email you within 7 days with a document for you to sign, then claim they will provide you with a refund. If they cant get hold of the seller within 60 days the refund remains in your account. (or so i was led to believe)
I'm sure a lot of you already know this but for anyone who has just found out they may have been shafted, i thought it may be helpful.
Ah nice one, good to see you had a positive result. I guess you can always rely on banks to get money off of people ...Yeah it's called a chargeback. I popped a post on the previous page to explain the difference between a chargeback and a section 75. Both handy to know if you've been ripped off

Some teeny bopper nicked my van once.I’ve messed up mine. Put a claim in then thought they may come good so cancelled it. Now there’s no way of re opening the claim.
