Chubby style Bottles Legal action from chubby gorilla

Looks that way prob loosing the market share due to the import of Chinese bottles .

What do they expect, the price they charge, best price wins, if they can't deal with that then they should get out the game all together or lessen their profit margin and compete, good luck to you and thanks for bringing this to our attention

We would hasten to point out that the bottles we use come from a UK Distributor , and perhaps you might want to address any future correspondence to them, because if there is any breach of your client’s intellectual property (which is denied) it is not made by us.


We would be prepared to consider using your client’s product if they are competitively priced, of satisfactory quality, and available on satisfactory terms. Perhaps we could have some samples and further details.

Don't understand how you can claim a patent on a bottle that's pretty much the same as every other squeezy bottle on the market. I would hazard a guess that it's a scare tactic, kinda like the TV license letters, especially since the patent is pending and not approved. And just because it looks the same (it's a bottle after all) doesn't mean it's patent infringing otherwise they could send the same letter to my contact lens solution maker.

Some stupid power play to scare up some business I think, keep us updated. Interested to see if they bother replying to your letter

I've come across this 'solicitors' firm before, a quick search of their name + 'scam' will give you an indication of their integrity.
I would be very surprised if Chubby Gorilla are behind this mailing, they may not even be aware of it.
The Registered mark for 'Chubby' is for the US only (unless I am misinformed)
The last thing I would ever do is contact them though, once you do that, they know there is someone (a business) ripe for making a demand to. It's basically a form of 'legal' extortion, although the legality is very questionable.
If you're genuinely concerned, take legal advice, but I wouldn't necessarily take it to heart that you have been targeted, it's little more than phishing using snail mail.

At the end of the day it does not matter whether they are legit, or scammers.
The letter that Ecigbase (post 32) in a polite way says get fucked we ain't doing nothing about it.

Bit of an update

well this is as real as it can get very big law firm and chubby have spent millions on this i all ready know of 1 big major e liquid brand as been forced to change to there bottles or would have not been allowed at the expo and had to buy 1 million bottles from chubby . Also they had there solicitor at the expo all day handing out letter to suppliers using the chubby style bottles

........ i'm lost.

Me too. I’m picturing chubby as some dodgy gangster trying to corner the plastic bottle market. Wandering about the vape expo with a couple of heavies putting the frighteners on anybody with bottles. “av got a million bottles outside wi your name on them. pay up” kinda thing!
