Guess I'm being pedantic but you did say "you can't legally buy it"

pedantry can sometimes be quite useful.

but, is it possible for something to be legally bought, if it is legally prohibited from being sold?

are buying and selling part of one single transaction between a buyer and a seller?
 
or put another way, would buying it make you complicit in an illegal transaction, whether or not you were the party committing the offence proscribed in law?
 
I get where both of you are coming from but iirc the TPD relates to sale prohibition.
 
prohibiting something being sold also prohibits the buying of it.

try it out yourself, see if there is any way you can buy something, but not be sold it. :)
 
Rather than trying to trawl through gov sites and all the regs I decided to ask Aria AI instead. Ultimately, I don't think Joe Bloggs buying a litre or two for home-brewing has anything to worry about regarding consequences. However, the sale of it to non-qualifying individuals is illegal. You cannot legally buy an illegal product. It's highly unlikely that you would face any consequences for doing so as a home brewer but there could be consequences for more extreme cases.

I think it was intended to scupper the big big big non business registered bathtub mixers , as you say the odd litre here n there wont be a problem in fact I highly doubt at the time they even knew or if they did care about wee Tam mixing away in his gaff. But if wee Tam became big Tam and was ordering 50 litres a month tae his gaff then questions will be asked.
