Just wondered what everyone's thoughts are on the advertising bans included in the tpd are? I have a YouTube channel like many others, and think when the regulations come into play will this be the end of our YouTube vape channels here in the UK/EU? What are your thoughts peeps?
I read that it was down to the provider of the content I.e YouTube to block and or delete content including any vape/ ecig content from the Eu?

The advertising bans aren't included in the TPD, it's a wholly separate piece of legislation that, like the TPD, have not yet been officially adopted into UK law and could yet change drastically, given today's encouraging developments on the TPD.

If there is a restrictive ban that will cover product reviews drafted in then....ill just carry on doing it regardless, much like many other reviewers are going to do. Too many loopholes to exploit, it can't be policed or enforced, social media don't care....

Hate to contradict you buddy but advertising of ecigs IS in the TPD. Its implementation is being dealt with separately which is confusing everyone :)

As for loopholes I'm liking your confidence.

That will be where I'm getting confused- was under the impression from talking with others it was separate legislation ;)

Wherever there are loopholes, I'll exploit them. And I won't be taking any notice of potential bans on reviewing :D

Reading back through it I could exploit the living shit out of this even in current form, for example I could provide information on a product as long as I don't provide an outright blatant opinion on it. That's just one loophole I have found ;)

Surely we just review nic free juice, and advertise nic free juice??

Unless I banged my head I thought we got a confirmation that nic free was defo not covered?

It does seem like nic free juice is exempt- which is one giant loophole begging for exploitation

Don't know if it's just me, but reading through the latest Gov release it seems the laws around advertising, sale and promotion of tanks too could pertain to cigalikes and basic gen 1 devices sold already containing e liquid, rather than the equipment 99.9% of us on this forum purchase and use that are sold without e liquid already contained within

There's still nothing I can see in there that outright bans the advertising and promotion of variable wattage and mechanical mods?

I could be corrected, I'm running on about 5 hours sleep over the last few days...

It's in the definition of an E-cig, however my reading of the rules on advertising says that as long as it's non commercial, Informational or instructional then it will be fine - Plus Youtube isn't hosted in the EU so they can't force them to take things down...
