As I work for the Police I can tell you I haven't heard of anyone fining someone for vaping and driving. But if it happens please let me know.
The legislation wording is for using a "handheld communication device" not electronic. So do not worry...lol

Got the MVP2 for this exact reason, very easy to hold in your left hand and change gear at the same time, and can steer with my right hand, perfect!!

I think it all depends on the officer... I have had a copper staring at me say next to me on the traffic lights whilst holding an EVIC with a kayfun on top (not a small device) I was also driving a sign written company vehicle. And they did nothing. Even though there were plumes of smoke going out the window. Considering its illegal to smoke in a company vehicle I'm surprised he didn't say something..

I was under the impression that it's not in the remit of the police to deal with contraventions of the smokefree legislation... more the sort of thing that local authority 'compliance' officers would be interested in.

I think at the moment it's just "driving without due care and attention" that could be applied, but just vaping seems unlikely to attract any attention - not sure the same could be said for refilling

There are a few taxi owners round here that have been fined for smoking in their taxi,caught by the councils "enforcement officers" (official speak for park warden as they chase people not picking up their dogs shit,parking attendant as they issue fixed penalty notices to dumb fuckers that triple park outside the paper shop "for 5 mins" and block the entire street,taxi police as they check you have all the first aid/fire extinguishers/clean seats etc and probably 10 other official duties included)
