Nick Clegg hasn't read the TPD

There's a thread on here with a vid of an anti TPD demo in Paris and that started me thinking that it was a European thing.
I'm no politico either but from what one reads it seems that they can more or less impose those European laws and such on us without our parliament being able to do much of anything about it.
Fair enough our MEPs have a say but if a directive exists then presumably they've already had their say before the directive was enacted or whatever they do to bring it into force.
 
This is a regulation and regulations "are directly applicable and binding in all EU member states without the need for any national implementation decision." To me that means when passed it becomes law throughout the EU, without requiring the additional consent of individual member states and is subject to the European Court of Justice and not a national court system.

Would our own politicians have any say on it? Yes, our MEPs do. But Westminster politicians don't once the regulation forms part of EU law. MEPs do belong to political parties of course so they can decide how their MEPs vote. Because it's a regulation, our MPs can say "don't blame me, blame the EU".

While strictly speaking true there is precedent for individual member states ignoring or overturning EU legislation for the benefit of their own country. However the UK government has been one of the members most reluctant to do so, and I doubt they will change their stance over this.
 
From what I've read, one of the major issues / flaws with article 20 is that it flouts the legal process of the EU and would therefore be unlawful in all member states (hence TW's successful bid to enter into a Judicial Review over it).

Anyone with more than 2 brain cells to rub together could see that the TPD as in its current form could potentially constitute a public health nightmare.

Im about as knowledgeable with regards to EU legislation as I am with vaping but, does this then concern imports from outside of the EU or would it only cover the manufacture within the EU?
Article 3b states that "The nicotine-containing liquid does not contain nicotine in excess of 20 mg/ml"
As in, allowed to be produced and/or imported?
