Of course they are. You think BAT etc are just going to ignore European regulation?
 
I was chatting with mannikon about this today. We both agreed that we can't see any similarity between our mods & tanks and a cigarette/ecig. I think its going to be a tough one to regulate with such grey areas. Much like everything else they rush through the EU courts. no thorough thought process just rush it through and hope no one notices the loop holes which of course have/will be found.

Nicotine in PG or VG for DIY e liquid mixing is the product we are least clear about at the moment. It is something of a grey area.
It will be illegal to sell e liquid at more that 10ml in size or 20mg in strength. However, nicotine isn’t e liquid and isn’t vaped alone.

Nicotine does have other applications, though not really for the general public. So again, we doubt that Trading Standards would allow retailers to sell nicotine alongside other vaping supplies. If this is the case, we may set up another separate business just for nicotine, if there is a demand from our DIY customers for the decent quality vaping grade nicotine that we currently are able to supply.

As "Nicotine, in trace amounts, occurs naturally in eggplant, red peppers, tomatoes and potatoes" are these also going to be subject to the TPD?

These will have to be marked as "not for sale to under 18s or idiots" and will be sold in packs weighing no more than 0.24 Kg, one pack only per customer.
 
20mg plus Nic base and drippers, the two most debated so called "grey area" items. Personally I don't think either will be legal under full tpd.
 
Am I right in thinking the following?.... The juice maker could sell you a 30mil or 100mil bottle of eliquid which is nicotine free? The same vendor can then sell you the required amount of nicotine in a separate smaller bottle?

They might in theory.
But in practise would it work?
The strongest base they can supply is 18mg (folks tend to say 18 rather than 20), so the10ml of that base they can sell you could be used to make 30ml at 6mg or even 60ml at 3mg.
Cloud chasers would be okay...... Anyone needing more than 6mg would be screwed.
I can't seem them bothering.
 
One thing I'm still not clear on, does an atomiser count as a tank? Some forums say yes, they will all have to be no bigger that 2ml (so goodbye Crown, Rafale, the Para tank I've been waiting all year for! etc) others say no, the TPD does not class atomisers like these as tanks, so they are exempt from the maximum size rules.

Can anyone tell me if 5ml refillable atomisers such as these are allowed under the new legislation?
